Terminating employee without notice illegal, rules AP high court

Terminating an employee from service without giving notice is against the principles of natural justice, and such orders are illegal, ruled the Andhra Pradesh high court in a recent judgement. A division bench of the court upheld the earlier orders of the single judge, which set aside the orders issued by the commissioner of intermediate education, terminating two record assistants and one watchman without giving any notice.

K V R Srinivas and G Srinivasacharyulu, who worked as record assistants, and I Nagaraju, who worked as a night watchman at a government junior college in Dumpaguda under Akividu mandal of West Godavari district, were appointed in aided posts. Contending non-payment of salaries, they first moved the high court in 1997. The court directed the state government to pay the salaries. Subsequently, the government preferred an appeal, and a division bench of the high court also ruled in favour of the petitioners in 2004, declining to interfere with the single judge’s orders.
