Newsweek reports that American firms like OpenAI, Instacart have posted listings in the San Francisco Chronicle, with applicants urged to send resumes to immigration or “global mobility” departments.
According to Department of Labor regulations, positions must be advertised openly, including in at least two major Sunday newspapers.
Employers must also publicize the opportunities on a state workforce agency website, internally within the firm, and via two other promotional channels of their choosing.
In addition to the fact that such ads request applications to be sent only to immigration or global mobility departments via paper mail or email-only applications, without mentioning walk-ins.

The apparent trend once again highlights work-based visas, particularly the H-1B, which benefit tech companies, as well as the ongoing tension between the need for immigrant workers and whether companies are importing cheaper labor rather than hiring American-born or permanent resident workers.
If companies are continuing with these practices, then it will likely only add to the ongoing debate around the H-1B and its place within the U.S. immigration system. President Donald Trump has shown his support for the program, but his Vice President, JD Vance, has been vocal recently that it needs to change.
The majority of American workers believe that H1B visa holders are being granted a green light as the job market continues to experience layoffs. The data, according to many on X, says that firms frequently increase their Foreign Labor headcount before layoffs, indicating that the replacement was premeditated.
