In a significant ruling, the Telangana High Court has reaffirmed that government employees cannot be forced to accept promotions against their will. The court overturned an earlier decision that had required a senior medical professor to take up a principal’s role at a newly- established government college in Mahabubabad.
The case involved a professor of Ophthalmology from Gandhi Medical College in Secunderabad, who was promoted to serve as principal of the new institution through a government order issued in July 2025. The professor chose not to accept the position, citing ongoing academic responsibilities and personal circumstances, including the need to care for an elderly parent.
A single judge had previously dismissed his challenge, stating that the promotion served public interest and classifying the principal’s role as part of the teaching faculty. The court had reasoned that his presence was necessary to meet regulatory requirements for the new college.
However, a division bench of the High Court took a different view. It clarified that under the Telangana State and Subordinate Service Rules, employees are explicitly allowed to decline promotions by not assuming charge within a stipulated period. The only outcome in such cases is the loss of that promotion for the relevant cycle, with no disciplinary consequences.
The bench also addressed the nature of the principal’s role. It held that the position is primarily administrative and not part of the teaching faculty for regulatory calculations. This distinction weakened the earlier argument that public interest demanded compulsory acceptance.
Concluding that the prior ruling misapplied both the service rules and the concept of public interest, the High Court allowed the appeal and annulled both the promotion order and the earlier judgment.
